Save the wall of separation at the Supreme Court: Stop Kavanaugh!

We are in the civil liberties fight of the century. The wall of separation between state and church, our secular government, our godless Constitution — everything that FFRF battles for is in jeopardy. We need your help — we need your voice.

The nomination of Judge Brett Kavanaugh to replace Justice Anthony Kennedy threatens our secular republic. Kennedy was the nominal swing vote on the court, and while often disappointing, he held firm on abortion and LGBT rights. Confirmation of Kavanaugh would tilt the Supreme Court to the religious right for more than a generation. Losing the Supreme Court to another Gorsuch, Thomas or Alito would forever change the landscape of First Amendment law. Every landmark case protecting the rights of nonreligious Americans is at risk, dating back to the landmark McCollum decision in 1948 barring religious indoctrination in public schools.

With your help, we’ve defeated other zealous Trump nominees. The outcry of concerned citizens has stopped Supreme Court nominees in the past. Thanks to citizens like you, Robert Bork was defeated in 1987 and, instead, Anthony Kennedy was confirmed. Senators need to hear — loudly and clearly — you, their constituent, will not only vote against them in the future if they vote to confirm Kavanaugh, but will actively work against them.

Kavanaugh has already proven to be a threat to the wall of separation between state and church.

In a brief to the Supreme Court, Kavanaugh played Chicken Little over a school prayer case in 2000, insisting that by refusing to give students in a public school a megaphone to pray at school events, the Court would create an “Orwellian world… the full extermination of private religious speech from the public schools would be well on its way.” In that case, Santa Fe v. Doe, the Court did strike down the megaphone prayers — thanks to Justice Kennedy’s vote — and Kavanaugh’s prediction that the sky was falling turned out to be pure bluster.

Also Judge Kavanaugh: Filling out a 5-blank—name, corp. name, date, address, sign—form is a “substantial burden” on religion. 808 F.3d 1 (2015) 

We can do this. But it will take sustained effort on all our parts. Please call your senators. Email your senators. Tweet your senators. Facebook your senators. They need to constantly hear from you. DO NOT LET UP. Never think that your actions are wasted — Senate offices DO feel the heat when constituents put pressure on them.
